Upon receipt of the facts of the matter, the applicant signs a letter of intent, that upon acceptance of the matter by MCSLF, they will enter into formal agreements with MCSFL. MCSFL instigates and pays for a search into the assets of the prospective defendant, if required. The IP or client's lawyers provide a costs estimate for taking the matter to trial. In the event that MCSLF instructs counsel to assist with the review of the merits, it will pay for that advice. |  |

If the application is approved, MCSLF makes an offer to take an assignment, or to fund the cause of action. A funding agreement setting out the commercial and legal terms is signed. ATE insurance policies are put into place to cover any unforeseen circumstances. |

The matter is either litigated in the client's name, Solicitor’s name (where an assignment has been made) or that of the IP. The IP or client may need to provide assistance on an as hoc basis e.g. providing background papers and helping to locate witnesses. |

Success - MCSLF is reimbursed all costs incurred. The IP or client receives the pre-arranged proportion of the net proceeds of the claim.
